Analysis of Three Characters in The Sun Also Rises - Literature Essay Samples

Following the tumult and terror brought upon by the First World War, the so-called â€Å"Lost Generation† was hopelessly scattered across Europe and often characterized by lost, aimless souls who were dissatisfied with hedonistic lives lacking in purpose and morality. Ernest Hemingway’s The Sun Also Rises personifies several of these dark souls and their unsuccessful attempts to safely find balance and satisfaction. The males of the novel, notably Robert Cohn and Jake Barnes, struggle against feelings of feebleness and inferiority due to their respective woes, which are amplified in an unforgiving post-war setting. Cohn is alienated as he clings to his bothersome pre-war notions of love, chivalry, and honor and realizes how little genuine friends he actually has. Jake is left impotent by the war, a physical affliction which results in his prolonged mental anguish. Meanwhile, these two broken, emasculated souls bounce and swirl around the irresistible Lady Brett Ashley, who is largely dissatisfied and unhappy as well, cracked by the post-war world yet incapable of owning up to her true feelings. Through these characters, The Sun Also Rises reflects universal crises in truth with which the characters find themselves trying come to terms amidst moral ruin, social chaos, and widespread cruelty. Despite never having actually gone to war, Robert Cohn’s insecurities, cultivated by his spinelessness and compounded by his Jewish blood, lead him on a path of self-destruction with the war-torn expatriates until he is forced into disillusionment, a ferociously violent and tragic boiling point. Hemingway details Cohn’s recent past immediately as the novel begins: â€Å"Robert Cohn was once middleweight boxing champion of Princeton It meant a lot to Cohn. He cared nothing for boxing, in fact he disliked it, but he learned it painfully and thoroughly to counteract the feeling of inferiority and shyness he had felt on being treated as a Jew at Princeton.† (11) Hemingway simultaneously glosses over Cohn’s fatal flaws and establishes core themes of male competitiveness and insecurity. Indeed, Cohn’s shortcomings as a coward and a Jew segregate him from other men and force him to relentlessly seek acceptance in any form. This insatiable yearning for acceptance proves to be damaging to all parties when combined with the hostility of his supposed friends at Pamplona. Cohn’s need for acceptance also gives rise to fear of rejection and loss. As such, Cohn is unable to separate himself from Jake, Brett, and company as their patience begins to dwindle and their heckling turns to pure animosity. Similar to the situations regarding his ex-wife and Frances, Cohn clings adamantly to Brett, choosing to ignore the blatant lack of reciprocated affection and the constant drunken badgering from Mike. Cohn’s crisis comes to a head as soon as Pedro Romero is added to the mixture. Seeing Brett â€Å"pimped out† by Jake devast ates Cohn and serves as his own equivalent to a figurative castration. Jake’s actions provide enough of an emotional impact on Cohn to finally push him over the edge after years of cruelty. Cohn snaps, brutalizing those in his path, as well as debasing his own pre-war moral code. In a single tragic spectacle, Cohn tramples over all the men involved, including himself as he finally acknowledges his pitiful life and the unspeakable damage which he inflicts upon Romero. Cohn loses it all: sportsmanship, honor, love, and, most importantly, Brett. Ultimately, Cohn yields to his insecurities and frustrations at the cost of violence and severe lashes to his pride and morality. Jake, although initially unable to acknowledge the harmful emotional impacts of his impotency, slowly evolves from post-war malaise to finally acceptance of his condition. Initially, Jake’s narration is sharp, condescending, and often indirect, particularly in reference to his injury and the consequent sensitivities which go along with it. For example, Hemingway expresses Jake’s bitter voice, â€Å"I was very angry. Somehow they always made me angry. I know they are supposed to be amusing, and you should be tolerant, but I wanted to swing on one, any one, anything to shatter that superior, simpering composure† (28). Here, Jake’s dissatisfaction and frustration develop into fierce jealousy. He observes â€Å"them† as almost alien beings devoid of masculinity, yet still struggles to accept himself as their inferior due to their proximity to Brett, the crux of Jake’s insecurities. It is Jake’s inability to exhibit his love for Brett which embitters him and fosters his feelings of inferiority. Indeed, these feelings find ample opportunity to manifest themselves, be it through animosity toward Cohn or Brett’s other numerous friends and partners or through soul crushing self-deprecation and hopelessness. When alone, Jake frequently finds his â€Å"hard-boiled† demeanor to be no match for the despair he truly suffers with regards to his war injury and his relationship with Brett. However, by the end of the novel Jake is emotionally drained by his cataclysmic experience at Pamplona. With these events freshly in Jake’s perspective, Brett once again entertains the notion of a relationship together. Hemingway concludes with Jake’s final, cynical reply: â€Å"Isn’t it pretty to think so?† (251). At this point, such a dream has lost all perceptible value in Jake’s mind as he has come to a state of bitter yet understanding acceptance of the impossibility of their love. Jake fully realizes any feeble assemblage of a â€Å"relationship† was likely to end in similar fashion as her other relationships: wretched, numb, and broken. Acknowledging that the idea of a fulfilled life with Brett is nothing more than a fleeting dream finally liberates Jake to a certain degree. Lastly, Brett’s crisis of â€Å"unrealized love,† only exposed when she confides her sorrows in Jake, appears to seek momentary flings of closure through fake stints of love rather than a definitive conclusion, despite the blatant emotional wreckage Brett leaves behind after her feeble attempts of love collapse and explode. Prior to the poignant final exchange between herself and Jake, Brett leaves before her the devastation of Cohn and Romero, as well as inciting her intentions to return to an equally heartbroken Mike. Above all, Brett’s sexuality acts as a form of release, the only manner of satisfaction and contentment she is able to utilize, although highly impermanent and often damaging to the men involved. However, despite this outright dependence on sex, Brett’s insistent love for Jake, which cannot be consummated, leads Brett to conceal much grief under the surface. Her internal misery is in many ways similar to Jake’s own. The major differe nce lies in their respective methods of coping with the heartache. Although both seem to fully respect their love to be a fanciful delusion, Brett continues to force herself upon partner after partner, as if she were addicted to the reciprocation of false love, an opiate to dull her senses of the everlasting post-war condition. Playing well the role of Circe, Brett even replies to Jake’s early pleas for a life together: â€Å"I don’t think so. I’d just tromper you with everybody. You couldn’t stand it† (62). Brett is fully aware of her need for artificial romance and denies Jake the possibility of even attempting a life together; she knows fully well of the prolonged suffering that would ensue. Eventually, both Jake and Brett come to terms with this harsh, brutal reality in their own way. Jake relies on his slow, painful internal mediation, while Brett insists on drifting haphazardly from one hedonistic pleasure to the next in hopes of distracting herself sufficiently enough in order to maintain her resolve and normality. Ultimately characterizing an entire era of crisis, Cohn, Jake, and Brett all struggle painfully with their respective dejections and in due time come to some form of acceptance. Depictions of harsh realities within the novel reflect the cruelty and challenges experienced under the thick blanket of the post-war condition. To Hemingway, the current state of the world was one of dashed hopes and emotional withdrawal marked by fleeting, unattainable dreams of what life could have been.

On the next day, Melaine and Brad had a fight and Brad asked her to leave also asked her to forget the extra bonus she had paid. The parties are governed by Contract law. In the case of Williams v Roffey Bros and Nicholls (Contractors) Ltd [1990] 1 AII ER 512, it was held that when a practical benefit is received out of any contract, it will be considered a valid consideration. Therefore, the practical benefit being the early completion of work, it can be said that the consideration is valid and therefore Melaine can sue Brad. In the case Musemeci v Winadell Pty Ltd (1994) 34 NSWLR 723, the same principle was upheld that in case of an benefit received in return of an assigned work, it will be termed a valid consideration. For a contract to be valid in law, a few elements need to be taken into consideration-parties, a legally enforceable agreement and consideration. In this case, Melaine is the interior designer of Brad who was asked to work on ten consecutive days to finish the work on time. After doing so, they had a fall out and Brad decided to not make the payment as was promised. The relationship between Brad and Melaine is that of employer and employee and the consideration here is the $3000 that Brad had promised to pay Melaine for completing the work. Contract can be either express or implied. In case of an express contract, the terms are clearly laid down and in case of an implied contract, the terms are understood from the contract and they are not clearly spelled out. Contracts can again be of two kinds- oral or written. When the terms of the contract are communicated verbally, it is called oral contract and when it is done in a formal way, it is called a written contract. In this particular scenario, it was an express and oral contract with a valid consideration and therefore Melaine can sue Brad for breach of contract. Rob has bought furniture but doesnt want to keep them but the shopkeeper will not take it back because it has been used. Having no way of selling it, Rob puts and advertisements for $20,000 and responding to the advertisement, a man comes to check it. The man has an uncanny resemblance with a well-known actor Vince Colosimo and that man asks Rob to call him Vince as a result of which Rob is convinced that he is the famous actor. The truth is that he is not the actor and on the contrary, he is a rogue who looks like actor. Vince loves the furniture and gives Rob $5000 and says the remaining $15,000 he will transfer electronically in two days. Next day, two of Vinces friends come and collect the furniture. After not getting the payment, Rob takes the help of police who trace the furniture to Judy who says that she has bought from someone who looked like a celebrity. In the case of Walton Stores (Interstate) v Maher (1988) 164 CLR 387, the principle of Promissory estoppels was discussed wherein the points were laid down that would make successful claim of an estoppels. In this case, a legal relationship was assumed by Rob and based on that assumption In the current case, the rogue who looked like the celebrity Vince, convinced Rob into believing that he will pay the remaining amount by paying the $2000. From the conduct of Vince Rob was convinced that he will pay and it formed an implied contract as it could be gauged from the action of Vince, it was an assumption made on the part of Rob. Acting on that assumption, Rob gave the furniture to him and as a result of that reliance suffered detriment. The principle of promissory estoppels applies in this case because though there has been a failed compliance management, there has been an assumption on the part of Rob and based on that assumption, Rob has faced an economic loss of $15,000. Rob sold the furniture and as a result faced an economical loss. Judy had no knowledge of the legal relationship that existed between Rob and Vince and without any knowledge bought the furniture from Vince and therefore he is not liable to pay any amount to Rob. No legal or contractual relationship exists between Judy and Rob and therefore Rob cannot recover the amount from Judy. Judy had no intention to cause any economic loss to Rob and in good faith had bought the furniture from Vince. Jeff Price is an accountant having sound knowledge of his subject. Rob is a dentist who meets Rob at a party and tells his that he wants to expand his business. Jeff being slightly inebriated advices Rob to expand his business telling him that his business is in a safe position to expand, relying on Jeffs advice, Rob borrows an amount of $50,000 but it turns out that it was a bad business investment. Rob has defaulted on the Northpac loan and as a result of the failure to pay Jeff has been sued for damages. Misstatement is a false statement which has been made without taking proper consideration of facts (Roberts 2017). A misstatement is a negligent statement not made carefully and which has the capability to mislead anyone. Misrepresentation is when a party makes a false claim based on facts which are untrue and thereby induces the other party to enter into the contract, it can give rise to an actionable claim (Van, Reinecke and Lubbe 2016). A misstatement can be both fraudulent and non-fraudulent. In case of a non-fraudulent misstatement, it is very difficult to fix liability because intention cannot be gauged in such cases. Any statement made with an intention to cause harm can be termed unlawful whereas if the intention to cause any loss is missing, it is not possible to assign liability. Misrepresentation is any untrue fact which is directly linked to the terms of the contract. Again, when the person induces the other party to enter into the contract, he must have recklessly made a statement though knowing the truth. In the respondents defence, if it can be proved that the other person relied on his own judgment and not on the respondents claims, he cannot make a case of misrepresentation. Conclusion When it comes to attaching duty of care, it is not done so in cases of financial matters. Liability can only be attracted in cases where the person had reason to base his action on the persons advice. In the present case, Jeff was an accountant and he does not owe any duty of care towards Rob. Jeff was in an inebriated state and having being aware of his conditional to not give sound advice under the influence of alcohol; Rob should not have based his decision on his advice. Human rights are basic inalienable rights which are paramount for a healthy and secure living. Every human being has basic human rights which shall include health, life, dignity and liberty (Fussler, Cramer and Vegt 2017). In a globalized world, the need of the hour is to recognize that every person has the right to live with dignity and their basic human rights should be respected. A human right to health suggests that everyone has the right to get the maximum attainable health which shall be free from any abuse or torture. The UN Global Compact Human Rights which are a derivation of Universal Declaration of Human Rights mandate that everyone should be treated with equality irrespective of their gender, race, ethnicity, caste and nationality (Hakim 2015). As a practicing dentist, it is the moral duty of Rob to ensure that his patients get proper medical care and they are not discriminated on the basis of any trait which is intrinsic to their being. Rob, being a dentist has an obligation towards serving others and therefore to make sure everyones health issues are addressed and taken care, he has to take special care. His profession is to help people in need of healthcare and keeping in mind the UN Declaration of Human Rights and its basic principles, it is imperative that he treats his patients with utmost care and passion. Access to medicine is another aspect of ensuring that everyone is healthy and treated with equality (Gibson 2017). Medicine should be free to people in dire need of it and Rob should make sure that his patients get proper medicinal aid when they are in need and in cases of patients who cannot expensive medical treatment management, they should be given free medicines to ameliorate their pain.
